Limited Warranty

Effective Date: May 20tn, 2022.

    The AURA Devices One Limited Warranty is a manufacturer's warranty. It provides a warranty where it is not provided by consumer law and/or if it's duration is less than one year. Consumers have the right to choose whether to claim service under the AURA One-Year Limited Warranty or their consumer law rights. Important: The AURA Devices One-Year Limited Warranty terms and conditions shall not apply to consumer law claims. For further information about consumer law, please visit the AURA Devices website or contact your local consumer organization.

    Please note: All claims made under the AURA Devices One-Year Limited Warranty will be governed by the terms set out in this warranty document. Your AURA Devices-branded hardware product ("Product") is warranted 'against defects in materials and workmanship for ONE (1) YEAR from the date of original retail purchase ("Warranty Period") when used in accordance with AURA Devices' user manuals (refer to help.auradevices.io.). Under this warranty, you will be able to direct your claims to AURA Devices even in situations where you purchased the AURA Devices Product from a third party. If a defect arises during the Warranty Period, AURA Devices, at its option will (1) repair the Product at no charge using new parts or parts that are equivalent to new in performance and reliability, (2) exchange the Product with a product with equivalent functionality formed from new and/ or previously used parts that are equivalent to new in performance and reliability or with your consent, a product that is at least functionally equivalent to the Product it replaces. This warranty excludes normal depletion of consumable parts such as batteries unless failure has occurred due to a defect in materials or workmanship and damage resulting from abuse, accident, modifications, unauthorized repairs or other causes that are not defects in materials and workmanship.

    AURA Devices does not warrant, represent or undertake that it will be able to repair or replace any Product under this warranty without risk to and/or loss of information and I or data stored on the Product. In no event shall AURA Devices be liable for (a) loss or damage, which as of the Product's purchase cannot be regarded as being caused by AURA Devices' breach of these warranty terms; or (b) losses caused by the user's fault, loss of data or loss of profits or benefits.

    Any limitations of liability in this warranty document shall not apply to (i) death or personal injury pursuant to any mandatory law on product liability; (ii) fraud or fraudulent misrepresentation; (iii) intentional misconduct or gross negligence; (iv) or a culpable breach of major contractual obligations. A damages claim based on a breach of major contractual obligations or gross negligence will be limited to foreseeable damage typical for the sale contract concerned.

    AURA Devices will provide warranty service through one or more of the following options:

    (i) Mail-in service. If AURA Devices determines that your Product is eligible for mail-in service, AURA Devices will ask you to send the Product by specific address. AURA Devices will pay for shipping to and from your location if instructions regarding the method of packaging and shipping the Product are followed.

    (ii) Do-it-yourself (DIY) parts service. DIY parts service allows you to service your Product. If DIY parts service is available in the circumstances, the following process will apply.

    (a) Service where AURA Devices requires the return of the replaced Product or part. AURA Devices will ship a replacement Product or component to you with installation instructions, if applicable, and any requirements for the return of the replaced Product or part.

    (b) Service where AURA Devices does not require the return of the replaced Product or part. AURA Devices will ship you free of charge a replacement Product or part accompanied by instructions on installation, if applicable, and any requirements for the disposal of the replaced Product or part.

    (c) AURA Devices is not responsible for any labor costs you incur relating to DIY parts service. Should you require further assistance, contact AURA Devices by email: support@auradevices.io.

    If any term is held to be illegal or unenforceable, it shall be severed from this warranty and the legality or enforceability of the remaining terms shall not be affected.

    Software distributed by AURA Devices with or without the AURA Devices brand (including, but not limited to system software) is not covered by this Warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. AURA Devices does not warrant that the operation of the AURA Devices Product will be uninterrupted or error-free. AURA Devices is not responsible for damage arising from failure to follow instructions relating to the AURA Devices Product’s use.

    This Warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by use with a third party component or product that does not meet the AURA Devices Product’s specifications (AURA Devices Product specifications are available at www.auradevices.com under the technical specifications for each product and also available in stores); (d) to damage caused by accident, abuse, misuse, fire, earthquake or other external cause; (e) to damage caused by operating the AURA Devices Product outside AURA Devices’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of AURA Devices; (g) to an AURA Devices Product that has been modified to alter functionality or capability without the written permission of AURA Devices; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the AURA Devices Product, (i) if any serial number has been removed or defaced from the AURA Devices Product, or (j) if AURA Devices receives information from relevant public authorities that the product has been stolen or other security measures designed to prevent unauthorized access to the AURA Devices Product, and you cannot prove in any way that you are the authorized user of the product (e.g., by presenting proof of purchase).

    This warranty is governed by and construed under the laws of the country in which the product purchase took place.

    For Australian consumers:

    The rights described in this warranty are in addition to the statutory rights to which you may be entitled under the Competition and Consumer Act 2010 and other applicable Australian consumer protection laws and regulations. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Repair of the goods may result in loss of data. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

    For Canadian Consumers:

    Residents of Quebec are governed by that province's consumer protection legislation.

    For purchases made by consumers in the United Kingdom and Ireland: If a product is defective consumers may, in addition to any other rights which they may have under consumer law in the UK and Ireland, avail themselves of the rights contained in: for products purchased in Ireland: the Sale of Goods Act, 1893 (in particular Sections 12, 13,14 and 15), the Sale of Goods and Supply of Services Act,1980 and the European Communities (Certain Aspects of the Sale of Consumer Goods and Associated Guarantees) Regulations 2003 (S.l. No. 11/2003); for products purchased in the UK: the Sale of Goods Act 1979 (in particular Section 12), the Supply of Goods and Services Act 1982 (in particular Section 2) and the Sale and Supply of Goods to Consumers Regulations 2002.
